Participant Agreement, Waiver and Release of Liability

READ CAREFULLY. THIS DOCUMENT WAIVES IMPORTANT LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE FOR NEGLIGENCE.
1. Activities Covered and Acceptance of Risk
I, the undersigned ("Participant"), wish to take part in activities at Griffin Skate Inn ("the Facility"). These include, but are not limited to, roller skating, skate rentals, parties, use of any area or equipment the Facility provides, and all special events, seasonal and holiday attractions, including haunted trails, haunted houses and other outdoor events held on or next to the Facility's property (together, "Activities"). This covers indoor and outdoor areas, day and night, and areas with reduced or theatrical lighting.
I understand that the Activities involve inherent risks, including but not limited to: collisions with other people; falls on floors, pavement, grass, gravel, dirt, mud or uneven ground; tripping over roots, rocks, holes, props, cables or structures; reduced visibility in darkness, fog or haze; strobe, flashing or special effects lighting; loud noises and sudden movements; injuries from equipment, props or structures; weather conditions; the acts of other participants; and startle, fright or panic reactions. These may result in property damage, serious physical injury, emotional distress, or death.
I VOLUNTARILY ASSUME ALL RISKS OF THE ACTIVITIES, WHETHER OR NOT DESCRIBED ABOVE AND WHETHER OR NOT FORESEEN, ON BEHALF OF MYSELF, MY HEIRS, REPRESENTATIVES, SUCCESSORS AND ASSIGNS.
2. Release and Waiver of All Claims
I, FOR MYSELF AND MY HEIRS, EXECUTORS, ADMINISTRATORS, ASSIGNS AND PERSONAL REPRESENTATIVES, FULLY AND FOREVER RELEASE GRIFFIN SKATE INN, ITS OWNERS, MANAGERS, OFFICERS, EMPLOYEES, AGENTS, ACTORS, PERFORMERS, VOLUNTEERS, CONTRACTORS, EVENT PARTNERS, LANDLORDS AND INSURERS ("THE RELEASED PARTIES") FROM ANY AND ALL LIABILITY, CLAIMS, DEMANDS, CAUSES OF ACTION OR DAMAGES ("CLAIMS") FOR PERSONAL INJURY, PROPERTY DAMAGE, WRONGFUL DEATH OR OTHER LOSS ARISING OUT OF OR RELATED TO MY PARTICIPATION IN THE ACTIVITIES.
THIS RELEASE INCLUDES CLAIMS ARISING FROM THE NEGLIGENCE OF THE RELEASED PARTIES, TO THE FULLEST EXTENT GEORGIA LAW ALLOWS. It does not extend to gross negligence or willful misconduct.
3. Indemnification
I agree to defend, indemnify and hold harmless the Released Parties from any liability, Claims or expenses (including reasonable attorneys' fees and costs) arising out of my participation in the Activities, or any breach of this agreement by me, including Claims brought by others on my behalf.
4. Medical Treatment
I understand the Facility may not be able to provide immediate medical assistance, particularly in outdoor or dark areas. If needed, I authorize the Facility to seek medical treatment for me, including calling 911 or arranging transport to a hospital. I release the Released Parties from liability arising from any decision to obtain treatment, and I am responsible for its cost.
5. Use of Photographic/Video Likeness
I grant Griffin Skate Inn the right to use my photograph, video image or likeness for promotional purposes, including social media, marketing materials and the Facility's website, without compensation. If I do not consent, I will give the Facility written notice in advance.
6. Compliance with Facility Rules and Instructions
I agree to follow all posted or stated rules, safety instructions and staff directions, including the rules for any special event or attraction. Failure to follow them may result in removal from the premises without a refund.
7. Severability
If any part of this agreement is found invalid or unenforceable, the rest remains in full force to the fullest extent the law allows.
8. Governing Law and Jurisdiction
This agreement is governed by the laws of the State of Georgia, without regard to conflict of law principles. Any dispute arising from it shall be resolved exclusively in the state or federal courts for Spalding County, Georgia, and I consent to their jurisdiction.
9. Acknowledgment
I HAVE READ THIS AGREEMENT CAREFULLY AND UNDERSTAND IT. I UNDERSTAND THAT BY ACCEPTING IT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE. I ACCEPT IT VOLUNTARILY AND WITHOUT INDUCEMENT, AND I INTEND IT TO BE A COMPLETE AND UNCONDITIONAL RELEASE TO THE FULLEST EXTENT GEORGIA LAW ALLOWS.
I agree that my electronic acceptance of this agreement has the same legal effect as a handwritten signature.
HAUNTED TRAIL ADDENDUM
This addendum is part of the Participant Agreement above and applies to the Griffin Skate Inn Haunted Trail held behind the Facility on October 30 and 31, 2026.
A1. What the Haunted Trail Is
The Haunted Trail is an outdoor, walk-through Halloween attraction designed to frighten. It takes place at night on natural, unpaved ground in low light. It uses fog or haze machines, strobe and flashing lights, loud sounds, props, tight or narrow passages, and costumed actors who appear suddenly, approach participants and may follow or pursue them.
A2. Specific Risks of the Haunted Trail
In addition to the risks in Section 1, I understand the Haunted Trail involves these risks:
- Tripping or falling on roots, rocks, holes, mud, slopes, wet leaves or uneven ground, made more likely by darkness and fog
- Contact with branches, brush, insects, poison ivy or other natural hazards
- Collisions with props, structures, other participants or actors, especially if anyone runs or panics
- Strong startle, fright, anxiety or panic reactions, and the physical effects that can follow
- Effects of strobe or flashing lights, fog or haze, and loud noise
- Weather, temperature and changing trail conditions
I KNOWINGLY AND VOLUNTARILY ASSUME ALL OF THESE RISKS.
A3. Health Acknowledgment
The Haunted Trail is not recommended for anyone who is pregnant; has a heart condition, high blood pressure, asthma or other breathing condition; has a seizure disorder or sensitivity to strobe or flashing lights; has a recent injury or limited mobility; or has an anxiety, panic or similar condition. I confirm that I (or the minor I am completing this agreement for) can safely take part, and that I have chosen to participate knowing these warnings.
A4. Haunted Trail Rules
I agree to these rules, and understand that breaking them may result in removal without refund:
1. Walk at all times. No running.
2. Stay on the marked trail and follow staff directions.
3. Do not touch, grab, strike or chase actors, props or other guests.
4. No alcohol, drugs or impairment. No weapons, including toy weapons.
5. No smoking, vaping, open flames or lighters on the trail.
6. Phone lights and flashlights only where staff allow.
7. Children under 10 must stay with an accompanying adult at all times.
8. If I need to leave the trail, I will communicate that to the guide.
Parental guidance suggested for children 8 and under.
A5. Actor Contact
Actors are instructed not to intentionally touch participants. They may approach closely, make loud noises, appear suddenly and follow participants along the trail. I understand that accidental contact can happen in the dark and in crowded areas, and I accept this risk.
A6. Additional Released Parties
For the Haunted Trail, the Released Parties also include all actors, performers, volunteers, contractors and event partners working the trail, and the owner of the land on which the trail is held.
A7. Minor Participants
If the Participant is under 18, this agreement must be completed and accepted by a parent or legal guardian. By accepting it, the parent or guardian agrees to every term of the Participant Agreement and this Addendum on behalf of the minor and on their own behalf, confirms they have authority to do so, and agrees to indemnify the Released Parties for any Claim brought by or for the minor, to the fullest extent Georgia law allows.
